Terms of Service

These Terms of Service ("Terms") govern your use of the Image Foundry service operated by Image Foundry ("we", "us", "our") at imagefoundry.io. By using our service, you agree to these Terms.

1. Service Description

Image Foundry provides real-time image transformation, optimization, and content delivery via URL-based APIs. The service connects to your image storage sources (S3, GCS, Azure, etc.) and serves transformed images through a global CDN.

2. Account Terms

• You must be at least 16 years old to use this service.
• You are responsible for maintaining the security of your account and API keys.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete registration information.
• One person or entity may maintain no more than one free account.

3. Acceptable Use

You agree not to use Image Foundry to:

• Process or distribute content that is illegal, harmful, or violates third-party rights
• Transmit malware, viruses, or any destructive code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the service for cryptocurrency mining, DDoS attacks, or similar abuse
• Infringe on copyrights, trademarks, or other intellectual property rights
• Exceed published rate limits programmatically or via automation designed to circumvent limits

4. Payment & Billing

• Paid plans are billed monthly or annually in advance.
• All fees are non-refundable except within the first 30 days (see our refund policy on the Pricing page).
• We reserve the right to change pricing with 30 days' advance notice to existing customers.
• Failure to pay may result in suspension or termination of your account.

5. Intellectual Property

You retain all rights to the images you process through Image Foundry. We claim no ownership over your content. The Image Foundry name, logo, and branding are our trademarks.

The open-source components of Image Foundry are licensed under the MIT License. The SaaS service, documentation, and proprietary components are copyrighted.

6. Uptime & Availability

We target 99.99% uptime for paid plans. The free tier is provided "as-is" without uptime guarantees. In the event of extended downtime, Scale plan customers may be eligible for service credits as described in their SLA.

7. Data & Privacy

Your use of Image Foundry is also governed by our Privacy Policy. We process image data solely to deliver the requested transformations and do not use your content for any other purpose.

8. Limitation of Liability

To the maximum extent permitted by law, Image Foundry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, regardless of the cause of action.

Our total aggregate liability shall not exceed the greater of: (a) the fees paid by you in the 12 months preceding the claim, or (b) $100 USD.

9. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be deleted within 30 days.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
